TLR safeguarding: what happens when a school removes your TLR

If your school removes or reduces a TLR1 or TLR2 because of a change to its pay policy or staffing structure, the School Teachers’ Pay and Conditions Document (STPCD) entitles you to a safeguarded sum. That is normally the value of the lost allowance, or the difference if it was reduced, paid for three years. In some cases it ends earlier, including when your employment at the school ends. This page covers maintained schools in England under the 2026 document. The document applies to England only, and academies set their own terms.

When safeguarding applies

The document lists the circumstances. For TLRs, the main one is where the school decides that the responsibility you were paid for is no longer part of your duties, has changed, or now merits an allowance of lower annual value. A teacher who loses a post because a school closes or is reorganised, and takes a new post with the same authority, can also be safeguarded on salary and allowances.

How much and for how long

You are entitled to the value for three years: the full value of the old allowance if it is removed altogether, or the difference between old and new if it is reduced. The school must tell you in writing within one month of its decision. The notice has to give the reason, the safeguarded sum and the date safeguarding ends.

What does not get safeguarded

  • TLR3s.
  • A TLR1 or TLR2 awarded temporarily while you cover another post, such as for maternity cover or a vacancy, once the post stops being occupied.
  • A TLR1 or TLR2 held by a teacher on a fixed-term contract, after the contract expires.

The guidance adds one exception. A teacher with a temporary TLR or a fixed-term contract gets no safeguarded sum when the TLR ends, unless it is ended earlier than specified and the contract runs past that date.

When safeguarding ends early

Safeguarding stops at the earliest of several events. The ones most relevant to a classroom teacher are:

  • the three years end
  • the period the payment was made for ends, for instance a fixed-term contract
  • you receive a pay rise or new or higher allowance whose value equals or exceeds your old salary plus the safeguarded sum
  • you move onto a different pay range, for example into the leadership range
  • you stop being a classroom teacher, or your employment at the school ends

If you take a new TLR or SEN allowance, the safeguarded sum is reduced by that amount for as long as you hold it. Keep that in mind before you apply for another responsibility. The TLR payments guide covers the ranges.

If you leave the school

Resigning ends the safeguarded sum. The guidance says it stops if your employment at the school ends, except in the school closure or reorganisation case. A TLR also belongs to the post. If you move to another school, the new school decides whether you receive any TLR, as the moving schools guide explains.

If your TLR has gone and you are thinking of leaving, work out how much safeguarding remains. Say the school removed a TLR2 and you have been safeguarded for one year. Resigning at the next leaving date gives up the remaining two years of the sum. (The early release guide covers going sooner.) A union adviser can help you weigh that against a better-paid post elsewhere.

Extra duties

If your safeguarded sums total more than £500, the school must review your duties and give you additional duties it reasonably considers commensurate with the sum. If you unreasonably refuse, payment can stop, but the school has to give you written notice at least one month beforehand. You cannot be required to carry on in your former role during the safeguarding period.

What to check

  • the written notice: the sum, the end date and the reason
  • whether the school applies the STPCD (maintained schools must; check academy contracts)
  • how a new TLR or SEN allowance would change the sum
  • what duties the school expects in return

The teacher pay scales guide covers the pay ranges. If the change comes with a restructure, the redundancy rights guide may also apply.

Common questions

Is a TLR3 safeguarded?

No. The guidance says TLR3s are not subject to safeguarding. A TLR3 is a fixed-term award, so it ends when the term set at the outset ends.

Do annual pay rises reduce a safeguarded sum?

No. The guidance says the annual pay increases are excluded from the safeguarding calculation, so they cannot reduce or remove a safeguarded sum. Pay progression can.
